How Is Child Support Calculated in Tennessee?
Child support in Tennessee follows the income shares model, which produces a basic child support obligation (BCSO) by combining both parents’ adjusted gross incomes and accounting for parenting time. Adjusted gross income starts with wages, salaries, bonuses, commissions, pensions, and retirement plan income, then subtracts allowable credits such as self-employment taxes and child support paid for other children. A parenting day is counted when a child spends more than 12 consecutive hours in a parent’s care during a 24-hour period, so parenting schedules have a direct effect on the final obligation. The key factors considered in determining child support include:
- Income of both parents: The court examines adjusted gross income from all sources, including salaries, wages, bonuses, commissions, and other income after allowable deductions.
- Parenting time: The number of parenting days each parent has directly affects the BCSO. The parent with more parenting time may receive more support to reflect the day-to-day costs of raising the child.
- Childcare and medical expenses: Health insurance premiums and childcare costs are factored into the calculation on top of the base obligation.
- Education expenses: Extraordinary educational needs and tuition costs can be added to the standard support amount.
- Other relevant factors: Courts may deviate from guideline amounts when special circumstances exist, including a child’s particular needs or agreed-upon arrangements between parents.
Our Chattanooga child support attorneys are versed in Tennessee child support guidelines and can help you understand how each factor applies to your specific situation. We can work to pursue a fair assessment while protecting your parental rights.
Can Child Support Be Modified in Tennessee?
Yes, child support orders in Tennessee can be modified under certain circumstances. Tennessee law requires a showing of significant variance, generally defined as at least a 15% difference between the current order and the amount that would be calculated under current guidelines. Either parent may petition the court, but the requesting party must demonstrate that a qualifying change in circumstances has actually occurred. Common reasons for seeking modification include:
- Change in income: A substantial increase or decrease in either parent’s earnings, such as a job loss, promotion, or change in employment, can support a modification request.
- Change in parenting time: If the parenting schedule significantly changes, it directly affects the BCSO calculation.
- Medical or educational needs: A change in the child’s medical or educational needs may require adjustment to cover new expenses.
- Emancipation of a child: When a child becomes legally emancipated or the number of children either parent is legally responsible for changes, child support may be modified accordingly.
We can represent you in petitioning for a modification or defending against an unwarranted modification request. We can help you navigate the Hamilton County court process and protect both your rights and your child’s best interests throughout the proceeding.
Child Support Enforcement in Tennessee
When a parent fails to pay court-ordered child support, Tennessee law provides several enforcement tools to compel compliance. Payments are often processed through the Tennessee State Disbursement Unit, which disburses funds to the recipient parent and creates a record of what has and hasn’t been paid.
Available enforcement mechanisms include direct wage garnishment through the non-paying parent’s employer, interception of state and federal tax refunds, liens on real or personal property, and suspension of driver’s, professional, and recreational licenses. A custodial parent who isn’t receiving court-ordered support can also file a motion for contempt in the issuing court. Repeated non-payment can escalate the legal consequences significantly for the non-compliant parent.
If your child isn’t receiving the support they’re owed, our child support attorneys can help you pursue enforcement through Hamilton County’s Chancery or Circuit Court and use the available legal tools on your behalf.
When Does Child Support End in Tennessee?
In Tennessee, child support typically continues until the child turns 18 or graduates from high school, whichever occurs later. Under Tennessee Code Annotated § 34-1-102(b), if the child is still enrolled in high school at age 18, support continues until the child graduates or until the graduating class the child was a member of when they turned 18 completes, whichever comes first. There are exceptions to this general rule. If the child has special needs or requires ongoing support due to a physical or mental disability, the court may order support to continue with no fixed end date.
Support can also end earlier than the standard threshold if the child becomes emancipated through marriage, military service, or a court-granted declaration of emancipation. The precise end date is governed by the language of your specific child support order, and stopping payments without confirming that threshold can result in a contempt finding. Our child support lawyers can review your existing order, advise you on when your obligation ends, and help you formally close it out.

"Absolutely a ten on the stars rating"I want to give a ten stars but google has 1-5 stars. Jonathan Turner was my lawyer and my case and it's over and my dui (2nd) got totally dismissed. We went to court many times and it always got pushed forward to another day. We dealt with blood test result and inconsistent and retesting. Covid was also a big factor in my case being extended for months and months. Different DA"s, not a good deal on the table and other factors included in my case. In the end,,, absolutely a ten on the stars rating from me. Dismissed..... I recommend Jonathan and his group highly. Thank you Jonathan so very much!!! Thank you again!!!- Dale J.
